These terms govern your use of the HomeNest Pro platform and all related services provided by Homerenote.
Important Notice: Please read these Terms carefully before using HomeNest Pro. By accessing or using any part of the Homerenote platform, you agree to be bound by the terms and conditions described below. If you do not agree, you must discontinue use of our services immediately.
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and HomeNest Pro, operating under the Homerenote brand ("Company," "we," "us," or "our"). These Terms govern your access to and use of our website, mobile applications, and all related services (collectively, the "Platform").
By clicking "I Agree," creating an account, submitting a quote request, or otherwise accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Platform on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
These Terms are effective as of the date of your first use and remain in effect until terminated by either party in accordance with Section 10. We reserve the right to update these Terms periodically — continued use of the Platform following any such changes constitutes your acceptance of the revised Terms.
HomeNest Pro is an online lead generation and comparison platform operated by Homerenote that connects homeowners with pre-screened service providers across multiple home service categories, including but not limited to: home improvement and renovation, home security systems, home warranty coverage, and mortgage refinancing.
Our core service involves receiving project information from homeowners and matching them with up to four (4) service providers from our network who are best positioned to meet their needs. These providers may contact you via phone, email, or text message to provide quotes or consultations.
HomeNest Pro is a referral and comparison service only. We do not perform home improvement work, provide security installations, underwrite warranties, or originate mortgage loans. We are not a party to any agreement entered into between you and a service provider, and we do not guarantee the quality, safety, legality, or delivery of any services provided by third parties.
To use the HomeNest Pro Platform, you must meet the following eligibility requirements: (a) you must be at least 18 years of age; (b) you must be a legal resident or citizen of the United States; (c) you must have the legal authority to authorize services at the property address provided; and (d) you must not be subject to any court order or agreement that would prevent you from entering into these Terms.
By using the Platform, you represent and warrant that you meet all of the eligibility requirements listed above. HomeNest Pro reserves the right to verify your eligibility at any time and to terminate access for users who do not meet these requirements. Providing false eligibility information constitutes a material breach of these Terms.
Certain features of the HomeNest Pro Platform may require you to create a user account. When registering, you agree to provide accurate, current, and complete information and to keep such information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify HomeNest Pro immediately at support@homernote.com if you suspect any unauthorized use of your account or security breach. We will not be liable for any loss or damage arising from your failure to protect your login credentials. Each user may maintain only one (1) active account; creating duplicate accounts is prohibited.
HomeNest Pro reserves the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or engage in conduct harmful to the Platform, its users, or service providers in our network.
When you submit a quote request through the Homerenote Platform, you expressly consent to be contacted by HomeNest Pro and up to four (4) service providers from our network. This contact may be made via telephone (including automated dialing), email, and SMS text message, even if your number is listed on a national or state Do-Not-Call registry, subject to applicable law.
You understand that submitting a quote request does not obligate you to purchase any service, enter into any contract, or make any payment. Similarly, service providers are not obligated to provide a quote, and HomeNest Pro does not guarantee that any provider will contact you or that any quote you receive will meet your expectations or requirements.
HomeNest Pro makes commercially reasonable efforts to match you with qualified, licensed providers, but we do not independently verify the licensing, insurance, background, or work quality of every provider in our network. You are solely responsible for conducting your own due diligence before engaging any service provider, including verifying licenses, checking references, and reviewing contracts carefully.
By submitting a quote request, you acknowledge that any information you provide may be shared with multiple service providers simultaneously, and that those providers may use your contact information to reach out to you about their services.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMERNOTE / HOMENEST PRO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY SERVICES ARRANGED THROUGH IT.
Our total aggregate liability to you for any claims arising out of or relating to these Terms or your use of the Platform shall not exceed the greater of: (a) the total amount you paid to HomeNest Pro in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100.00). Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so these limitations may not apply to you.
HomeNest Pro expressly disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure.
The HomeNest Pro Platform may contain links to third-party websites, applications, and services, including those of our service provider partners. These links are provided for your convenience only, and HomeNest Pro has no control over the content, policies, or practices of any third-party site. We do not endorse and are not responsible for any third-party content, products, or services.
Any transactions or agreements you enter into with service providers or other third parties through or in connection with the Platform are solely between you and that third party. Homerenote / HomeNest Pro is not a party to such transactions and expressly disclaims any liability arising from them, including disputes regarding service quality, pricing, workmanship, warranties, or billing.
All content on the HomeNest Pro Platform — including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and the overall design and layout of the Platform — is the property of Homerenote or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any portion of the Platform without the express prior written consent of HomeNest Pro.
The "HomeNest Pro" and "Homerenote" names, logos, and all associated branding are trademarks of the Company. Nothing in these Terms grants you any right to use our trademarks, trade names, or service marks without our express written permission.
By using the HomeNest Pro Platform, you agree not to engage in any of the following prohibited activities:
Violation of any prohibited activities may result in immediate account termination and may expose you to civil or criminal liability. HomeNest Pro reserves the right to cooperate fully with law enforcement authorities in connection with any investigation of suspected illegal activity.
HomeNest Pro may suspend or terminate your access to the Platform at any time, with or without notice, for any reason — including but not limited to your violation of these Terms, suspected fraudulent activity, or if we discontinue the Platform. Upon termination, your right to use the Platform ceases immediately.
You may terminate your account at any time by contacting us at support@homernote.com or through your account settings. Termination of your account does not relieve you of any obligations incurred prior to termination. Sections 6 (Limitation of Liability), 8 (Intellectual Property), and 11 (Governing Law) shall survive termination of these Terms.
These Terms and any dispute arising out of or related to them or your use of the HomeNest Pro Platform shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Travis County, Texas, and the parties hereby irrevocably consent to personal jurisdiction and venue therein. If you are a consumer located in a jurisdiction that does not permit certain dispute resolution provisions, those provisions shall be modified to the minimum extent necessary to comply with applicable law.
To the fullest extent permitted by law, you and HomeNest Pro agree that any dispute resolution proceedings will be conducted on an individual basis only and not in a class, consolidated, or representative action. You and HomeNest Pro each waive the right to a jury trial in any legal proceeding arising from or relating to these Terms.
